The NSA, etc. can circumvent the law by asking other governments (such as Germany) to spy on Americans for them, and this makes it "legal." This information is found in the book THE PUZZLE PALACE  by Bamford (who the Government tried to censor). Also, under Bush's Patriot Act, any American can be labeled as a domestic terrorist, even if they are just attending a peaceful protest, for example.
